In 1975 the petitioner applied for a position with the Department of Health and was advised that because of inadequate vision (he is legally blind) he was not capable of performing the duties of the position. Petitioner filed a complaint with the Division of Human Rights, alleging an unlawful discrimination. In September of 1977 the petitioner took an open competitive exam for the same position and was placed on the eligible list. On June 6, 1978 a hearing examiner found...
