This appeal arises from the dismissal of counts V and VIII of plaintiffs' amended complaint by the Circuit Court of Kane County in which they allege that the defendants, Steven Fitzsimmons and William Fisher, had breached an implied warranty of habitability with regard to subdivided housing lots purchased by the plaintiffs.
