PURTLE, Justice.

The trial court ruled that appellee did not become a bailee for the appellant under the circumstances. The appellant's claim was dismissed and a judgment entered finding no bailment situation had been created and the appellant had not sustained the burden of proof relating to the alleged negligence of the appellee. The appellant moved for a new trial and the motion was denied. It is from the order denying a new trial that the appeal is taken.
