The defendant appeals from a conviction for false imprisonment (RSA 633:3) following a jury trial de novo in the superior court. We hold that the Trial Court (Bean, J.) erred when it denied the defendant's motions to dismiss for insufficient evidence. We therefore set aside the conviction.
