HAYS, Justice.

Following the shooting death of Charlie Frank Sargent on February 18, 1980, first degree murder charges were filed against Sargent's wife, Kate Marie Sargent, and three sons, Donald, seventeen, Cecil, fifteen, and Roy, fourteen. Immunity was granted to Cecil and Roy in exchange for their agreement to testify in the separate trials of Kate Marie Sargent and Donald.
