SMITH, Judge.

Defendant, Richard Austin Pierson, appeals his conviction of first degree murder. We reverse and remand for a new trial.

On March 14, 1977, defendant telephoned the police and reported that one Charles Schubert had committed suicide in defendant's apartment. When police arrived, they found Schubert dead of a single gunshot wound. Defendant was placed under arrest for investigation of homicide and taken to the Boulder County Criminal Justice Center...
