Immediately prior to trial defendant made an oral motion to quash the indictment against him in case No. 80CRS1321. Defendant alleged in his motion that the warrant failed to charge the proper offense in that the warrant charged defendant under G.S. 14-54 rather than G.S. 14-56. In addition, at the close of all the evidence, defendant made an oral motion requesting the trial court to give the jury special instructions with regard to G.S. 14-56...
