Lynn Duncan (appellant) instituted this workmen's compensation action against the Rockwood Insurance Company (appellee), which was the workmen's compensation insurer of the State of Louisiana, Department of Transportation and Development, appellant's employer at the time of his injury.

The trial court rendered judgment in favor of appellant awarding workmen's compensation benefits, but denying plaintiff's claim for penalties and attorney's fees...
