TUTTLE, Circuit Judge:

We have carefully considered the petition for rehearing in the companion case, Clark v. Harris, 638 F.2d 1347. Upon further analysis of the notices given in the two cases, we conclude that there is no substantial difference between them. We, therefore, sua sponte withdraw the original opinion in this case, 638 F.2d 1355
