Appellant was convicted of selling a controlled substance, lysergic acid diethylamide (LSD). He was sentenced to five years in the State Department of Corrections with two years suspended on condition of good behavior. Approximately thirty days after the judgment was entered of record, the appellant filed a motion for new trial on the grounds of newly discovered evidence.

The motion was denied and on appeal the appellant argues two points...
