OPINION

BISSETT, Justice.

This is an appeal from a conviction for class A misdemeanor obscenity under Tex. Penal Code Ann. § 43.23(c)(1) (Vernon Supp.1980-1981). Punishment was assessed at one day in jail with a $500.00 fine.
