On August 21, 1977, while driving his automobile on Route 28 in the Town of Ulster, petitioner was stopped by a Deputy Sheriff and thereafter arrested on a charge of driving while intoxicated. By determination dated June 28, 1979 petitioner's driver's license was revoked by the Commissioner of Motor Vehicles for refusing to submit to a chemical test in violation of section 1194 of the Vehicle and Traffic Law.
