On July 24, 1980 a two count indictment was returned charging Kevin L. Kessinger with violation of 21 U.S.C. § 841(a)(1), possessing cocaine, a Schedule II controlled substance, with intent to distribute. Count I charged an offense on May 27, 1980. Count II charged a violation on May 27 and May 28. After entry of a not guilty plea, defendant moved to suppress evidence seized on May 27 near midnight and...
