The defendant was indicted for murder in the second degree and criminal possession of a weapon in the third degree. A trial was had, at the conclusion of which the court submitted to the jury, along with the crimes charged, a charge of manslaughter in the first degree as a lesser included offense under the first count of the indictment. After two and one-half days of deliberation, the jury reported that it was hopelessly deadlocked...
