The appellants were charged with possession of marijuana. The appellant, Davis, was charged with simple possession and the appellant, Johnson, was charged with possession with the intent to sell. Both were found guilty at a bench trial. Johnson was sentenced to not less than one nor more than five years in the state penitentiary...
