Petitioner-appellant Leroy Homer Stough, an inmate of the Hawaii State Prison, was denied post-conviction relief under Rule 40, Hawaii Rules of Penal Procedure, by the circuit court of the first circuit. Petitioner's incarceration resulted from his plea of guilty to a charge of robbery in the second degree. In his petition, he claimed that his guilty plea was the result of ineffective assistance of counsel; therefore, it should be set aside and a new trial...
