Upon the return of a verdict of a jury that defendant was guilty of robbery as charged in an indictment, the court fixed his punishment at imprisonment for ninety-nine years and sentenced him accordingly.

A major insistence of appellant is that the trial court was in error in overruling defendant's "Motion to Dismiss for Failure to Prosecute" on the asserted ground "That the charge was returned more than six (6) months...
