We have before us defendant's motion for dismissal of the charges for violation of Pa.R.Crim.P. 1100 and also an application by the Commonwealth under the Mental Health Procedures Act of July 9, 1976, P.L. 817, sec. 101, 50 P.S. §7101 et seq., and particularly §§7403 and 7404, the same being sections 403 and 404 of said act.
