The main issue in this case is whether the defendant's right to due process of law was violated in imposing an enhanced sentence. The defendant alleges three violations of his due process rights. First, that he was not afforded a jury determination beyond a reasonable doubt of the facts relevant to the enhanced sentence. Second, that he was not given adequate notice of the possibility of an enhanced sentence for manifesting exceptional cruelty or depravity...
