Plaintiff sought an adjudication in the Court of Claims for contribution and/or indemnity for part or all of any sums adjudged against plaintiff in a separate circuit court proceeding for damages initiated by Terry and Barbara Dutoi. Defendants obtained summary judgment on the ground that plaintiff failed to state a claim upon which relief could be granted. GCR 1963, 117.2(1). Plaintiff appeals as of right. We affirm.
