This matter comes before the Court upon defendants' motion for summary judgment [Filing # 6].

This case involves a tax refund claim, with jurisdiction conferred by 28 U.S.C. § 1346(a)(1). The parties have stipulated to the following facts [Filing # 7]. During 1973, plaintiff James W.
