This is an action for patent infringement brought in this court under 28 U.S.C. §§ 1338 and 1400(b). On May 1, 1980, some two and one half years after the commencement of this suit, the plaintiff, Schreiber Cheese, moved, pursuant to Rule 15(a) of the Federal Rules of Civil Procedure, to amend its complaint by adding yet another party-defendant, H.
