Claimant has moved this court for an order pursuant to CPLR 2221 granting "a hearing as to its prior order dismissing petitioners [sic] claim". The motion is predicated upon a decision of the United States Supreme Court rendered after this court's order and, accordingly, we deem this a motion for reargument. (Mosca v Pensky, 41 A.D.2d 775.)
