Case held, decision reserved and matter remitted to Supreme Court, Erie County, for further proceedings, in accordance with the following memorandum: Defendants were convicted, following a joint trial by jury, of sodomy in the first degree and two counts of sexual abuse in the first degree. At trial the court granted defense counsel's request pursuant to People v Rosario (9 N.Y.2d 286) for the prior statements of prosecution
