Ellory L. Rhone, the defendant, sought leave of the court of appeals to appeal a pretrial order of the circuit court denying his motion to dismiss the criminal charges on double jeopardy grounds. The court of appeals denied the petition for leave to appeal, and this court granted the defendant's petition to review the decision of the court of appeals.
