The appellant, Johnny Wayne Spivey, was serving a three-year sentence in the Kentucky State Reformatory at La Grange when, in November 1977, the Estill Circuit Court indicted him for first-degree assault. On December 26, 1978, Spivey filed a formal request for a final disposition of all outstanding charges pursuant to the Interstate Compact Agreement on Detainers Act.
