FELTER, Justice.

Defendant-petitioner was tried, convicted and sentenced for vehicular homicide. The Court of Appeals affirmed the conviction, and from such affirmance defendant petitioned for a writ of certiorari. The sole question raised by the petition for certiorari is whether the trial court erred in refusing defendant's tendered jury instruction, N.M.U.J.I.Crim. 2.51, N.M.S.A. 1978, and consequently whether the Court of Appeals erred in affirming...
