OPINION OF THE COURT

FLAHERTY, Justice.

The case presently before the Court is an appeal from the denial by the trial court of a Motion in Arrest of Judgment requesting dismissal of the charges against the defendant for failure of the Commonwealth to bring him to trial within 120 days of remand of the record pursuant to Rule 1100(e)(2). We find that the trial court properly granted the Commonwealth an extension of time in this case and accordingly, we affirm...
