KELLY, Justice.

Plaintiffs, Vernco, Inc., Fox Lake Park, Inc., and Kenneth Nelson appeal from the order of the Martin County District Court dismissing their appeal from the proposed assessment for the improvement of a road in Martin County. We reverse.
