The trial court entered summary judgment against the plaintiffs on their complaint which alleged negligence and intentional torts on the part of the defendants. Defendants' summary judgment motion was premised upon GCR 1963, 117.2(1), i.e., that plaintiffs failed to state a claim upon which relief can be granted.
