Plaintiff, The Brothers Jurewicz, Inc., a former manufacturer's representative of defendant, Atari, Inc., brought suit to recover sales commissions. Atari denied liability, although it was unable to locate the parties' sales agreement. Atari subsequently found the agreement and, discovering that it contained an arbitration clause, moved the trial court for an order compelling arbitration.
