This is an appeal by the defendant Glenn Rushing who was convicted and sentenced for welfare fraud under the provisions of HRS § 346-34. HRS § 346-34 provides that:

Any person who, by means of a wilfully false statement or representation, or by impersonation or other fraudulent device, obtains or attempts to obtain, or aids or abets any other person to obtain public assistance to which he is not justly entitled, or a larger amount of...
