Judgment reversed, as a matter of discretion in the interest of justice, and new trial ordered.

Although we are in agreement with the Criminal Term's findings and conclusions, that defendant was neither denied his statutory nor constitutional right to a speedy trial, we nevertheless reverse the judgment of conviction and order a new trial to the defendant due to an error in the court's charge.
