Rozelle Tate, the named plaintiff in this case, is presently incarcerated in the Shelby County Penal Farm, a county workhouse operated under the authority of the government of Shelby County, Tennessee. Plaintiff has been incarcerated since 1979 when he was convicted of a non-infamous crime as defined by the laws of the State of Tennessee.
