Upon the call of the case for trial, the court stated to the jury: "It's my understanding that the state has advised the Court that they intend to proceed on the basis of a second degree murder plea." The defendant contends that such language gave the jury the impression defendant had pled guilty to murder in the second degree and that the language constitutes reversible error.
