This appeal by the State of Texas challenges the holdings of the courts below that respondent Tom Bounds was not engaged in the business of "transporting property for compensation or hire" and therefore, was not required to obtain a permit from the Railroad Commission of Texas. The trial court denied the State's request for civil penalties and injunctive relief under Tex. Rev.Civ.Stat.Ann. art. 911b (Vernon). The court of civil appeals affirmed. ...
