ALLEN, P.J.

Following a trial by jury on January 21, 1978, on charges of delivery of heroin contrary to MCL 335.341(1)(a); MSA 18.1070(41)(1)(a), defendant was found guilty as charged. On January 24, 1978, he was sentenced to prison for a term of 10 to 40 years and appeals of right, raising seven grounds for reversal. Of these, two merit our careful review.
