The defendant was convicted of manslaughter on an indictment charging him with the first degree murder of Robert Sultis. He appeals and assigns two errors in his trial. G.L.c. 278, §§ 33A-33G. He argues that the Commonwealth withheld from him exculpatory evidence which was material to his defense and that the prosecutor made an improper reference in his summation to the defendant's failure to call a particular witness.
