Respondent Sim challenged WAC 352-36-040(1) and (3).1 The trial court agreed with Sim and invalidated the regulation as beyond the limit of authority granted the Washington State Parks and Recreation Commission (Commission) by RCW 43.51.680. The Commission and intervenors appealed directly to this court. We affirm the trial court.
