MEMORANDUM OPINION

GLEN M. WILLIAMS, District Judge.

Petitioner Harold Dean Rivers has instituted this suit pursuant to the habeas corpus statute, 28 U.S.C. § 2254, attacking the validity of his confinement. Although presently incarcerated at the Federal Correctional Institute at Ashland, Kentucky, the subject of this action concerns a conviction for attempted murder entered in the Circuit Court of Lee County, Virginia.1
