LIACOS, J.

The petitioner, Dennis M. DeJoinville, was convicted of murder in the second degree and arson by a jury of the Superior Court in Worcester County on May 23, 1973. He was sentenced on the murder indictment to life imprisonment at the Massachusetts Correctional Institution at Walpole and on the arson indictment to a term of three to five years to be served concurrently. The judgments were affirmed by the Appeals Court on March 8, 1976. Commonwealth
