The appellant, Michael J. Albert, was indicted for operating a motor vehicle on August 20, 1979, while an order of the Superior Court remained in effect declaring the appellant to be a habitual offender and prohibiting his operation of a motor vehicle. 29 M.R.S.A. § 2298 (Supp. 1979-80).
