This is a motion by the County of Dutchess which, by order of this court, has been granted permission to intervene in this action. The county moves to modify a prior order of this court dated March 23, 1979, which directed the Commissioner of Finance of Dutchess County to pay the sum of $40,000 on deposit with it to Leemilt's Petroleum, Inc.
