In June 1973, Charles Allen Brandt, an employee of Stidham Tire Company, received severe injuries when a tire manufactured by appellee, Uniroyal, Inc., exploded as he was attempting to mount it on a customer's wheel rim. Almost three years later, in 1976, Mr. Brandt and his wife, as well as Stidham's workmen's compensation carrier, Liberty Mutual Insurance Company, jointly filed suit against Uniroyal.
