Memorandum Findings of Fact and Opinion

WILBUR, Judge:

Respondent determined a deficiency of $2,362 in petitioner's Federal income tax for the year 1976. The sole issue for our decision is whether one-half of the net capital gain reported by petitioner on her income tax return for that year is an item of tax preference pursuant to section 57(a)(9)1 and is thus subject to the minimum tax pursuant to section 56(a).
