This matter is before the Court on the petition of Lenwood Cole for a writ of habeas corpus under 28 U.S.C. § 2254.

Petitioner Lenwood Cole, a Missouri state prisoner, was convicted of second degree murder and assault with intent to kill with malice aforethought.
