Plaintiff/mortgagor Donovan Pearson (appellant) brought this action against defendant/mortgagee First National Bank (appellee) for breach of contract and interference with contractual relationships. At the close of the plaintiff's evidence, in a trial to a jury, the Bank moved for a directed verdict (judgment on the evidence) arguing the plaintiff failed to prove a breach of any contractual obligation and failed to prove damages.
