This is a suit by Benny Ricard under 42 U.S.C. § 19831 (Civil Rights Act) against the State of Louisiana; Steve Jones, a state trooper; and, the Department of Public Safety. Plaintiff allegedly was pistol-whipped by a state trooper and sustained injuries. From a partial summary judgment dismissing his claim for punitive or exemplary damages only, plaintiff has appealed.
