This is an appeal from the order of the Court of Common Pleas of Allegheny County, Criminal Division, by the defendant-appellant, Ernest Hazzard.

The record indicates that on August 8, 1978 the Commonwealth filed an appeal with this Court from the Order of Judge Ross on July 24, 1978 granting appellant's demurrer as well as the sue sponte demurrer to the firearms charges at No. CC7802449A.
