This case is now before the Court on the motion of the National Mediation Board (the "NMB") to dismiss, or alternatively, for summary judgment on the counterclaim.

This action was originally begun by Seaboard World Airlines, Inc. ("Seaboard") seeking a temporary restraining order and preliminary injunction barring the unions from engaging in self-help measures pending
